Proposed Piazza Project Litigation Update
On April 14, 2008, the City filed suit against TCD Enterprise, LLC and its
principal, Randy Wang (collectively “Wang”), the developer of the Piazza Las
Tunas Project, commonly referred to simply as the “Piazza.” The Piazza was
to be located at the northeast corner of Las Tunas Blvd and Rosemead Blvd
in the City of Temple City.
At this time, the City has determined to amend the City’s (and
Redevelopment Agency’s) complaint in the lawsuit against Wang to request
that the court declare the development agreement and related owner
participation agreement regarding the Piazza void pursuant to Government
Code sections 1090 and 1092, based on testimony by Randy Wang and his
former project manager, Jay Liyanage, given to a criminal Grand Jury in June
2009.
In light of this testimony, the City Attorney and the City Council have
determined it is in the best interest of the public to seek a judgment
declaring that the City’s prior approval of the agreements related to the
Piazza Project are void. Hence, this judgment if granted would allow the City,
developer, and citizens of the community to engage in the redevelopment of
this important property through a process that would meet the community’s
expressed desire for an open and transparent environment that includes
public hearings before the Planning Commission and City Council. Mr. Wang
has agreed to cooperate in the entry of such a judgment.
Several months ago, Mr. Wang presented plans to the City’s Community
Development Department proposing to change the previously approved
Piazza Project from a mixed use development proposal to an all commercial
development proposal. It is anticipated that the proposed new Piazza plan
could be presented to the Planning Commission within the next couple of
months.
